Terms of Service

Welcome to DreamStyle. These Terms of Service ("Terms") govern your use of dreamstyleart.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use DreamStyle. If you are under 18, you must have your parent or legal guardian's permission. By using the Service, you represent that you meet these requirements.

2. Your Account

You sign in using Google. You are responsible for keeping your account secure and for all activity that occurs under your account. Do not share your login with anyone. If you suspect unauthorized access, contact us immediately at support@dreamstyleart.com.

3. Credits and Purchases

DreamStyle uses a credits system:

• Each image generation costs 10 credits.
• Free users receive 1 free generation per device (watermarked, sign-in required to download).
• Credits can be purchased one-time or via subscription.
• Credits do not expire as long as your account remains active.
• Credits have no cash value and cannot be transferred between accounts.

4. Subscriptions and Automatic Renewal

All subscription plans (Weekly, Monthly, Yearly) automatically renew at the price and frequency shown at the time of purchase, until you cancel.

• Weekly Plan — $4.99 every 7 days for 150 credits
• Monthly Plan — $14.99 every month for 700 credits
• Yearly Plan — $79 every year for 700 credits per month, plus priority queue
• Topup — $3.99 one-time for 80 credits (does not renew)

You can cancel anytime in your Account page by clicking "Manage Subscription". Cancellation takes effect at the end of your current billing period. You will continue to have access until then, and we will not charge you again.

Subscription emails (renewals, receipts) are sent automatically by Stripe.

Plan Changes (Upgrade & Downgrade)

• Upgrades (e.g., Weekly → Monthly, Monthly → Yearly) take effect immediately. Stripe automatically calculates a prorated charge for the remainder of your current billing period, and your credits are updated to reflect your new plan.
• Downgrades (e.g., Yearly → Monthly, Monthly → Weekly) take effect at the end of your current billing period. You retain the benefits and credits of your current plan until then, and switch to the new plan on the next billing date. No prorated refund is issued for downgrades.
• All plan changes are managed through "Manage Subscription" in your Account page.

5. Refund Policy

• Credits already used are non-refundable.
• One-time Topup purchases are non-refundable once credits have been delivered to your account.
• Subscription cancellations: When you cancel, your credits remain usable until the end of your current billing period. We do not issue partial refunds for unused time.
• If you believe you were charged in error, contact us within 14 days at support@dreamstyleart.com and we will review your case.

6. Ownership of Generated Images

You own the images you generate with DreamStyle. You may use them for any lawful purpose — personal, commercial, on prints, T-shirts, social media, NFTs, marketing, or any other use.

However, note that under current U.S. copyright law, purely AI-generated images may not be eligible for copyright registration. This is a legal status of all AI-generated content, not specific to DreamStyle.

You retain ownership of the original photos you upload. DreamStyle claims no ownership over your uploaded photos or generated images.

7. Acceptable Use

When using DreamStyle, you agree NOT to:

• Upload photos of other people without their consent (including public figures, celebrities, coworkers, or strangers)
• Upload photos of children under 13, except photos of your own child with your parental consent
• Generate sexual, pornographic, or sexually suggestive content of any kind
• Generate content depicting real people in defamatory, deceptive, or misleading contexts
• Use generated images to harass, threaten, impersonate, or deceive others
• Use the Service for fraud, identity theft, or any other illegal activity
• Attempt to reverse-engineer, scrape, or abuse the Service or its underlying models
• Use multiple accounts to circumvent free-tier limits or other restrictions

Violation of these terms may result in account suspension or termination, without refund.

8. Responsibility for Uploaded Content

You are solely responsible for the photos you upload and the way you use generated images. DreamStyle does not pre-screen uploads and is not liable for any harm, claims, or damages arising from your use of the Service. If you upload a photo of someone else without consent, you assume all legal responsibility.

9. AI-Generated Content Disclaimer

DreamStyle uses AI to generate images. AI outputs are inherently unpredictable. We do not guarantee that:

• Generated images will be accurate, beautiful, flattering, or match your expectations
• Facial likeness will be perfectly preserved
• The selected style will be reproduced exactly as shown in our preview thumbnails
• Every generation will succeed (occasional failures may occur due to model behavior or service outages)

Credits are not automatically refunded for results you find unsatisfactory. We continually improve our prompts and models, but results are inherently subjective.

10. Service Availability

We aim to keep DreamStyle running smoothly but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or third-party outages (e.g., fal.ai, Stripe, Vercel). We are not liable for downtime or service interruptions.

11. Limitation of Liability

DreamStyle is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages.

Our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the past 12 months, or $100, whichever is greater.

12. Indemnification

You agree to defend and hold DreamStyle harmless from any claims, damages, or expenses arising from your use of the Service, your uploaded content, your generated images, or your violation of these Terms.

13. Termination

You may delete your account at any time by contacting support@dreamstyleart.com. We may suspend or terminate your account if you violate these Terms. Upon termination, your access ends and unused credits are forfeited.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in California.
